1. General Provisions – Scope

  • 1.1. These General Terms and Conditions apply to all orders placed by Consumers or Business Entities, both of which are referred to hereinafter as Customer, with
  • 1.2. All deliveries from HEALY to the Customer are carried out based exclusively on the General Terms and Conditions given below.



2. Prices and Delivery/Shipping Costs

  • 2.1. For prices, the stated prices don’t include taxes arising from the transaction, particularly sales taxes. The shipping address is decisive for location determination. Items sold by HEALY are subject to sales tax in certain states.
  • 2.2.The specific dispatch/delivery price is determined by quantity and delivery location and may be subject to an additional extended area surcharge.
  • 2.3. If you are not able to be present at the delivery location at the agreed time, we ask you to contact us again to agree on a new delivery date.
  • 2.4. Shipping costs are charged to the buyer and it depends on the delivery address when placing the order
  • 2.5. Custom products
  • For custom apparel products it will take about 2-4 weeks. The specific time depends on the product quantity/fabric/craft.


3. Graphic Processing and Production

The service offered by HEALY includes graphic processing and production processes.

In order to avoid any type of error or dispute, please pay attention to the following information:

  • 3.1. CONTROL: the final check of the order confirmation document is the responsibility of the customer. The object of particular attention will be the graphics of the product, the models chosen, the colors, the logos, the numbering, the names and the sizes.
  • PREVIEW: the preview images are considered for illustrative purposes, in the printing phase the proportions of the graphic elements could undergo slight variations to improve the fit to the model and sizes.
  • 3.2. LOGOS: If customers require customized logos, an additional fee will be charged based on the size and complexity of the logo design. The exact amount of the fee will depend on the specific requirements of the customer and the production process involved in creating the logo. Our company strives to provide high-quality logo customization services that meet the unique needs of each customer while remaining transparent about any additional costs associated with this service.
  • 3.3. Consequently to the acceptance and approval of the graphic sketch, HEALY will not be responsible for any errors resulting from the conditions listed above.


4. Production

By production, we mean the period of time that the ordered product takes from when the order is placed until the moment in which it will be entrusted to the shipper.

  • 4.1. Production of the Products will not commence until all outstanding payments, if any, have been paid in full.
  • 4.2. Although the seller speculates that the delivery will take place on an approximate date (depending on the product and the period), the Buyer acknowledges and accepts that this period of time it is an estimate and not a guarantee unless an EXPRESS service with mandatory delivery has been paid for.
  • 4.3. When an order enters the production phase it can no longer be changed.


5. Cancel an Order

An order can be canceled in the following cases:

  • 5.1. If the status of your order is processing, you can cancel your order within 2 hours of confirmation or payment.
  • 5.2. If the status of your order is in processing but more than 2 hours have passed, you can send a cancellation request to HEALY indicating your order number, our operators will check the status of the order and if it is not already at an advanced stage we can cancel it.
  • 5.3. In this case a percentage equal to 10% of the total amount of the order will be withheld relating to the costs of managing your order.
  • 5.4. If your order is already in a more advanced stage of processing (production, shipment, completed, etc ...) it will not be possible to cancel the order.

6. Returns and complaints

  • 6.1. In accordance with the legal provisions in force, the buyer has the right to withdraw from the purchase without any penalty and without specifying the reason, within the term of 14 days (pursuant to art.57 of Legislative Decree 206/2005) starting from the date of receipt of the products.

The right to return will not apply in the event that in the services and products of HEALY, the supply of goods made to measure or clearly personalized are included (art. 5 paragraph 3 letter c of Legislative Decree 185 of 22/05/99), or in the case of products intended for the Covid-19 health emergency (eg masks J-Mask), or included in the categories of art. 59 of Legislative Decree 206/2005.

  • 6.2. The item must not have been used and must be returned in its original packaging, in good condition, and suitable for re-sale.

In the absence of these conditions, it will not be possible to make the return and the relative refund/exchange of goods.

  •  6.3. The return costs are the responsibility of the buyer.
  • 6.4. The refund (or the exchange of goods) will take place only after the merchant has received the package and after the inspection to verify the conditions of the return.

Do not send the goods before you have received the merchant's reply by e-mail; failure to respond could significantly delay the processing of your request or even block it.

Don't forget to ask the courier for a receipt with tracking of the package to provide the merchant with proof of shipment. Similarly, by doing so you can follow the transport the item until it is received in the merchant's warehouses. If the return was made without tracking the package and the merchant does not receive the goods, unfortunately, you will not be able to obtain a refund.


7. Conditional Sale

Up to the payment of any monies owed to HEALY and the order is shipped, the goods remain the property of HEALY.


8. Warranty Claims

  • 8.1. The term of limitation for claims under warranty for the goods provided is two years starting from the receipt of such goods. If the Customer is in business then the term of limitation is one year.
  • 8.2. Deviations deemed standard throughout the industry as well as technically unavoidable tolerances in color, quality, material, weight, or any other specifications do not represent reasonable grounds for any complaints by the Customer.
  • 8.3. When printing on textiles, slight variations in tonal values, both in print proofs and the following order are always possible and unavoidable. HEALY will do its best to reproduce as realistically as possible the colors appearing on the website, in the (online) catalog, and in any product brochures depicting the range of products. In particular, those colors that appear on the website of HEALY are dependent on the individual monitor settings of the Customers, which is why HEALY cannot take any responsibility or provide any type of warranty for the comparability of these colors.
  • 8.4. All control designs and color proofs are to be reviewed most carefully by the Customer prior to their approval for production. HEALY will not take responsibility for any mistakes that the Customer missed whilst reviewing the order once approval has been granted.


9. Copyright /Third Party Protected Rights, Release from Liability, Inadmissible Designs

  • 9.1. If the Customer should provide his/her own motif or otherwise influence the product (personalization of text), the Customer assures HEALY that the text and motif are not subject to any rights held by third parties. The costs resulting from any breaches of copyright, registered designs, personal rights or rights to the use of a name, label or trademark will be borne solely by the Customer. The Customer also assures HEALY that, by personalising the product, he/she is also not breaching any other rights held by third parties. In principle, each Customer is responsible for the use of all copyright-protected texts, logos, images, slogans or designs, and must obtain the appropriate written consent of the copyright owners to use any of the above and present these to HEALY unrequested.
  • 9.2. The Customer shall release HEALY from all demands and claims which may be asserted by third parties due to the infringement of any of the above rights, inasmuch as the Customer is responsible for the breach. The Customer shall reimburse HEALY for all defense and legal costs and other damages resulting from any such action.
  • 9.3. All texts, illustrations, or any other special design made at the request of the Customer, that are deemed to invade and infringe upon the privacy rights of a third party, to contain pornographic material, to serve the purposes of spreading propaganda, or to incite criminal actions or to participate therein will not be realized by HEALY.
  • 9.4. Teams or Clubs, especially, must be vigilant about meeting guidelines, conditions, and restrictions dictated by their respective associations. HEALY shall not assume any liability or warranty concerning these regulations.
Customer service
